Hi everyone, I am currently working for company A who filed for my H1B and it got picked in this year’s draw. Now I got cleared interview for my dream company B , way higher comp and better work. Now I enquired about H1B premium processing and my company said if I want to pay for it I can opt for it. Will H1B premium processing allow me to switch companies before October ? I am looking for more clarity on H1B premium processing and H1B transfer policies. Until the first h1b from company A is approved, yiur lottery doesnr hold any value.
No. You have to wait until October. Even if approved, it doesn't go into effect until then and the employer can simply rescind it since it belongs to them.
you need the petition approved, and be working there (have a paystub to prove) for atleast 1 day on or after oct 1.
I did exactly this but back in 2012. H1b approved in May and start date was Oct 2012. I got an offer in July, they said I should pay for premium processing, which I did. Once transfer was approved, I gave 2 weeks notice to the original employer, who rescinded H1B but the transfer was done, so it did not matter. I joined new employer in September on opt, and H1b kicked in on October 1st.
AFAIK you h1b doesn't get activated until oct so there is nothing to transfer. I could be wrong but I have not heard anyone working on h1 before oct start date in last few yrs.
I am on the same boat and trying to research more on this. Apparently its possible but that all depends on ur Company B's lawyers on how they petition.
