CA employment lawyer here. Maternity leave is typically job protected leave meaning the employer must allow you to return to your job at the end of your leave. With that said, an employee may legally be laid off while on protected leave if the reason for termination is unrelated to the leave taken. In these situations, the focus becomes whether the business justification for termination is legitimate. It is (unfortunately) not unusual for employers to terminate employees on maternity leave because of concerns the employee will not perform at the same level as prior to the pregnancy. Anyone who is terminated during maternity or disability leave should speak with an employment lawyer.

Nope, when Amazon did the big layoff people on maternity were let go. I was told at the time that it would be discrimination to exempt them if they otherwise would have been included
