I have a question if anybody can help, I am planning to take a road trip to Toronto from New York this month ( May 2024. My current Visa stamping is until October 2024. Is it safe to travel to Canada and will there be any problem while entering the US from border since my stamping expiration is not too far? #workvisa #h1b
U crazy? They will not allow the entry back to usa
Isn't his visa valid till October 2024?
Totally fine. I have done it previously. Just make sure to carry the new I797 with you and show that to them while re-entering back. They will put the updated expiry on your I94
I'm in a similar boat and mine is expiring end of July 2024. I'm planning on travelling in June to Canada. Lawyers have done the paperwork and say they'll fine extension once I return. Do you think there's a problem with the plan?
Sounds a little dangerous. Usually an extension is filed 4-5 months in advance of expiring
If you come back within 30 days, you dont even need valid US visa; even expired one works; just carry latest I-797; Enjoy.. Its pretty chill n easy process..(Given you have Canadian Visa/PR)
Don’t you need canadian visa?
You need a Canadian visa to enter Canada but to return to US you don’t need US visa. Just a valid i797 is enough even if US visa is expired. It’s the AVR rule
No problem at all. You can even enter US back with an expired h1b visa - read AVR (automatic visa revalidation)! There are a few clauses, but in general it will work for short trips. I’ve done it multiple times. Good luck.
