EB2 NIW now or EB1A later

I've submitted my profile to Chen Immigration and they've agreed to handle my case under their Approval or Refund policy. Have a research-focused background and 5 years of Experience as a Product Manager working in AI/ML Profile: 10 Patents 13 Research Publications + 5 in Conference Proceedings 3 Book Chapters 100 citations 90 papers peer reviewed + 25 Conference Papers Peer Reviewed Any thoughts or experiences with this? Would appreciate any advice or suggestions!

Have they agreed to give refund if not accepted under EB1A or EB2 NIW? If the former go for it. If latter go for it still and get in queue so you can use the priority date later for EB1

I think it’s the priority date, Even If I apply for EB1A later, I will probably get a priority date 4-5 months from now. That’s what I can understand from the responses

If you are from India and dont have priority date, lock that priority date. NIW is the safe bet and do it quickly. You can apply EB1A after NIW approval. Even EB1 will take 5+ years or more based on portings from EB2 and existing backlog.

There are around 16700 (as of dec 2023) EB1 India petitions (approved I140) waiting for priority date (yet to file 485). If we consider 2 dependents (spouse and kid) per principal applicant, a total of 50000+ visas are needed. Historically, India EB1 gets around 12K per year (this may increase or decrease based on ROW demand and family spillovers). It will takr around 4+ years for current backlogs to clear. Assumimg OP will file next quarter responded with 5+ years. Also there are (will be) portings from EB2/3 to 1, so they will even delay the estimated time as they get GC first and backlog keeps growimg in EB1 as well.

Do the NIW now and lock down the priority date as soon as possible. Your background looks solid for NIW approval. Chen helped me apply for NIW when I only had 6 papers and 50 citations. With the PP request, I got the approval notice in just 2 weeks! I hope you can get your I-140 approved without any hassle.
