Re constitutional issues: title VI is very well established. The federal government is not obligated to fund institutions that go against their higher standards of anti-discrimination (higher than what applies to any standard individual/business). Schools that want to permit such speech just wouldn't get federal funding
No one has a problem with anti discrimination. The problem with this one is that it's NOT anti discrimination. It's a blanked check for 3rd party to decide what they deem and not deem antisemitic Sorta like comments here: anything they don't like- that's antisemitic. And that's what people have problems with
The point, from a constitutional perspective, is that it is what Congress encoded by law as what they consider a title VI violation (where title VI itself is a prior law, dealing with federal funding of schools, not in itself a court ruling). If it passes the Senate and signed by the president, it's the law and while it can be challenged in court, I don't see what the constitutional issue is As far as it being a blanket check to a 3rd party, it isn't. The bill specifies precisely what the definition is, which is the ihra definition as of a particular date.
