Asking for a friend. He has been unfairly put on PIP given an impossible project as product manger to release product update in 3 weeks that an entire team cant do in a quarter. He had been on medical leave 3 months back and feels this is a fake plan to execute him . can he complain to some one in HR or any other committee for harassment or unfair treatment ? He wants to go to lawyers to find out if he has a case for retaliation

Nope. PIP goes through HR and HR will never allow it if there was an ounce of legal standing for the employee. Your friend is pretty fucked if he used FMLA. If he hasn’t, go through pip and in the pivot week FMLA for 6 months.
How does HR understand what the tasks are about?
They don’t. They just look at the legality. Was there any retaliation of any kind that can be proved beyond perception? If yes, they won’t allow a PIP. That’s why the power to authorize a pip lies with HR not with the manager.
You can argue all you’d like but PIP is NEVER about your performance. It’s a plan to get rid of you without getting sued. Amazon does it a lot and they are pretty damn good at it.
