My husband was fired 2 weeks back when he was admitted to the hospital. He has been dealing with health issues and he is on few trial medications, which are very important for his condition. Without a job, we’ll be out of status. He just got of the hospital and still recovering. We have no information on why he was fired or laid off. Any advice is appreciated on how to address this situation. Thank you.
Not enough info. Company? Country? Etc
I'm sorry to hear that you're going through this. Since employment in the United States is at will, you may not receive any information from your spouse's employer. To ensure continuous coverage, you can extend the existing insurance through COBRA, although it may be costly. Additionally, you can enroll your spouse in your employer's insurance plan for new treatments, as losing a spouse's job is considered a qualifying life event for insurance purposes.
Thank you. I’m working with my HR to get him on my insurance plan. But Since I’m on h4 EAD. I’ll lose my visa as soon as he his H1B grace period passes.
Get a lawyer immediately. You may be able to negotiate 6 months to 1 year of severance package. Also don’t sign anything from company esp their severance package.
Did he exhaust his sick days etc… and didn’t get permission for extended leave of absence? Was there any disagreements between your husband and the management related to his health issues recently? And first thing to do is to take care of insurance coverage.
He had just applied for his short term disability leave and we got his termination letter. There were very few interaction with his manager before this happened. He was hospitalized more than 3 times this year. But he was meeting his expectations but not exceeding it.
Talk to an employment lawyer- you can go to the CA state bar for a referral. The timing of the termination is definitely fishy enough to warrant a consultation
I'd try an employment lawyer especially if he had short term disability or leave (while also doing the above insurance advice)
He had requested for short term disability leave and he got the termination letter
Holy Shit OP. You can def fight this
Are you on H1B or H4? If you are on H1B then change your husband visa to H4.
f these employers. not sure if its too late to get on fmla.
They said they're already fired. Even being on FMLA doesn't prevent you from being laid off. But OP only said her husband was fired.
ok there pitchfork mob wannabe, u have 1 side of the story, and even then it's nothing out of the ordinary. Go call your politicians if you want the laws changed.
Thank you Biden

Any recommendations for an employment attorney in Bay Area CA
Try to file ead based on your husband’s i-140 under this https://www.uscis.gov/working-in-the-united-states/information-for-employers-and-employees/employment-authorization-in-compelling-circumstances You and your husband probably get 1 year ead and you can renew after that. This will solve your visa issue.

Cobra
Why cobra ? It is too costly and you have to pay around 600 usd every month
600 USD vs 200k in hospital bill, you do the math
