Do you know anyone or are you employed with SAP US, but live in Canada (through PR)? How easy is it? Do you need manager approval or take your manager into confidence? Does SAP stop your US Green Card process if HR gets to know that you moved to Canada?
Why would SAP keep you on US payroll when they can pay you much less on Canadian payroll?
This guy is probably trying to play extra smart. Take remote work in California and work from Canada instead.
Haha, I never thought this way... In that case, work remote in California, and live in Mexico or Nigeria or India or Bangladesh or Malaysia...!!! You will become instant millionaire.š Jokes apart, I know many people live in Toronto or Mississauga, and they drive to Detroit for work every week! Same between Vancouver and Seattle. So was wondering, is that an option in SAP? Does HR or manager allow this arrangement?
Technically you can obtain a US green card without ever visited the United States. The PERM certificate and the I-140 donāt require any presence in the US. The first one is to verify that there is a shortage of people able to perform specific duties. The second is a job offer. And you can perfectly wait for your date to become current while you are outside of the US.
That said. When your date becomes current, you have exactly one year to start the third phase either through consular processing or adjustment of status. So it is important that your US manager knows that you will need to be transferred to the US when you receive the GC.
Not sure about SAP but have a few friends who've done it. They no longer have any status in US, moved to Canada with PR, continue being paid in USD with Canadian bank (USD account). The catch is your employer will either continue paying US taxes on your salary, which then requires you to set aside some money to pay taxes on your international income tax in Canada and then recoup when filing taxes in the States. Or, employer stops paying US taxes on your salary and you pay your own Canadian Taxes. Either ways, it's a complicated process and most companies would rather not go through the headache because it's tricky.
SAP will not want you to work for a US business from Canada. If you live in Canada but commute to the US (like the Detroit example), thatās probably ok. But if you actually work within Canada, SAP will want to transfer you to a Canadian subsidiary and pay you in CAD, Canadian benefits, etc. Your pay may drop, because they adjust for COL. And you need to have your own work auth in Canada (unless SAP is sponsoring your move). SAPās Mobility team can do all the paperwork for you. If youāre moving because of your spouseās job, theyāll even pay some of the relo cost.
The H1B status is not a āuse it or lost itā status. You can perfectly spend 3/4 of your time outside of the US. You can even claim the days spend outside of the US at extension time. (But keep track of every of your travels.) Itās 6 years IN the US. You might get questioned when you enter the US. But as long as you can provide any document that prove that you are still actively employed by your H1B sponsor, they will let you in.
I agree with FFPM52, it doesn't bother US immigration office as long as you have correct documents, and able to prove the same. For sure, they will question you everyone and they will stamp your passport everytime, so pages will be done quickly, unless you have Nexus card or global entry card!!
